Can you legally record a client meeting in France?

Updated on

Yes, with the client's consent and after informing them. Article 226-1 of the French Penal Code punishes with one year in prison and a €45,000 fine recording, without consent, words spoken in a private or confidential setting; consent is presumed when the recording is made openly and the person does not object although able to.

The GDPR also requires informing the person about the processing of their data (purpose, retention, rights). In practice: announce the recording, get explicit consent and keep a trace of it.

Good practice before pressing "record"

  1. Announce the recording and its purpose (writing the advice record, keeping proof of the advice given).
  2. Ask for the client's explicit consent and note it (at the start of the recording is easiest).
  3. Explain retention and rights (access, erasure); refer to your privacy policy.
  4. Offer an alternative if the client refuses: manual notes.

And by phone?

The same principles apply: the other party must be informed before recording starts. When you record a call with Meetingize, an automatic notice informs both parties as soon as the call is merged.

  • Meetingize does not obtain consent for you: the professional must.
